Draft reform to the general organic code of processes by determining a term to be cited, in article 53, using the AHP method
Abstract:
The present work aims, to reform the General Organic Code of Processes, by determining the period of time to make known the claims of the plaintiff, in Article 53, which aims to regulate the judicial summons; and, that the terms are the same, for the two procedural parties; and, avoid the abuse suffered by due process. This is why the relevance of the investigation carried out to solve the problem raised, taking into account that the judicial summons is the first Judicial Act of a substantial nature in due process, which currently generates delays in the processing of trials and Hence, it shows helplessness, violation of the principles of speed, immediacy, speed and due diligence guaranteed in the constitution, principles of speed and due diligence guaranteed in the Constitution of Ecuador. For this, the technique known as neutrosophic AHP was applied. This is a variant of the numerical AHP designed by Saaty, which when incorporating the neutrosophic sets, the uncertainty of decision-making is taken into account, in addition to the calculation with linguistic terms and the inclusion of the element of indeterminacy.
