Abstract:

The Habeas Corpus Action is a Constitutional Guarantee whose purpose is to protect the liberty, life, physical integrity and other related rights of the person deprived or restricted of liberty in an illegal or arbitrary manner, having as objective of this study to orient the study to the effectiveness of the habeas corpus as a jurisdictional guarantee in defense of the fundamental rights of the people, The objective of this study is to orient the study to the effectiveness of habeas corpus as a jurisdictional guarantee in defense of the fundamental rights of persons, so that it can be used as part of a legal basis and can be used to restore when rights have been violated by public authorities or private individuals when a person is illegally or arbitrarily deprived or restricted of liberty, This is an issue of great importance so that the different processes can be aired immediately and at the same time the essential rights of every human being recognized in our Constitution are respected and allows us an immediate protection to the freedom of the person who has been illegally detained, whatever the denomination of the fact questioned as detention, arrest, imprisonment, kidnapping, forced disappearance, or being in compliance with a sentence have been violated rights against his integrity or is at risk of being attempted against his life. The historical method, logical analysis, comparative legal analysis method and as a scientific research technique, interview and analysis of documents were used to determine the discussion in an analysis of sentences such as jurisprudential precedents.
