Efectiva punibilidad del tráfico ilícito de bienes del matrimonio cultural en la legislación ecuatoriana

Abstract:

The study of effective penalties for the offense of unlawful trafficking of patrimony assets is approached from the doctrinal aspect, starting with the study of criminality, continuing an extensive analysis of the cultural heritage elements, classifications, and importance; to finally get to delve into what illicit trafficking in cultural property is. In the second part of this work the topic is addressed from a legal and constitutional point of view, where an investigation of existing standards was made on the legal-juridical context about the smuggling of assets, as well as the institutions involved in the fight against the analyzed crime, one of the most important points in this chapter is the breakdown of each of the elements of the offense under OIPC (Organic Integral Penal Code) as illicit transportation and trading and smuggling of cultural heritage assets. Regarding the research methodology applied in this titling work, it was decided to conduct polls in order to examine through the different social actors, their knowledge about crime, related rules and institutions; and also the analysis of a court case obtaining as results clear reflections of the incessant problems that exist regarding the punishment of this crime is included….
