Ahp method of saaty to determine the factors of compensation quantum for immaterial damages in criminal matters in Ecuador

Abstract:

The compensation is a monetary compensation to cover the damages caused or to repair them, in which the victim, his relatives or his close relatives have the right to it. It should never be disproportionate, if it is, it ceases to be a right and becomes an abuse. In order to study the social phenomenon that constitutes the determination of the possible factors to be considered in calculating the quantum of compensation for non-pecuniary damage in criminal matters, the following work was carried out using Saaty’s AHP method. As a result of the application of the method, it was obtained that for the calculation of the quantum, the conditions of the victim, then the damage infringed, the seriousness of the crime and the need for assistance services should be taken into account as a priority.
