Abstract:

The Extraordinary Protection action will proceed against judgments or final orders, in which rights recognized in the Constitution, have been violated by action or omission. The appeal shall proceed when the ordinary and extraordinary remedies have been exhausted within the legal term, unless the lack of imposition of these resources is not attributable to the negligence of the person holding the right violated. Constitutional actions may be presented by any individual citizen or collectively there is no Appeal. The Extraordinary Protection Action is a resource and is "extraordinary" that is, of an "exceptional" nature, it is born and exists to guarantee that the supremacy of the Constitution is safe, to guarantee and safeguard the legal security and the due process regarding its effectiveness and respect. To constitutional rights, which have been violated or affected by the action or omission in a judicial decision. Both the operators of justice, and lawyers in free professional practice, must be provided with the proper training, to exercise and apply the right in relation to the Extraordinary Protection action.
