Analysis of the weighting of rights in vulnerable groups in ecuador


Abstract:

The Constitution clarifies the priority groups to ensure that their rights are respected and enforced. However, the Constitution leaves out other rights that have the same hierarchy and weighting process, so there are certain irregularities in the arbitrary actions of judges, where it is more important to determine in a rigid way what the law establishes than the protection of rights itself. This situation requires a systemic analysis in order to offer a possible solution that will mitigate it. The objective of this study is to analyze the weighting of rights in vulnerable groups in Ecuador. This is in line with the hypothesis that the analysis of this issue and its irregularities will allow for the definition of the causes of its incorrect application and will enable the formu-lation of strategies to eliminate this situation. Saaty’s MASP and AHP techniques and the conceptual maps will be used for the case studies. As a conclusion, the need to create a comprehensive standard for these cases and the training of judges in Constitutional Law is presented.
