Expert system for the integral reparation and affectation to the life project in the penal integral organic code

Abstract:

The damage to the project of life, as a mechanism of integral reparation appears in Ecuador, in criminal matters having as a background the sentences of the Inter-American Court of Human Rights that develops this concept, being understood as the affectation to the aspirations of the people who are frustrated by the commission of a crime, Therefore, the objective of this study was to analyze this type of damage, and the results refer to reparation for the life project most commonly used in cases of death. Its quantification is still subjective, and it was concluded that judges apply the mechanism of material reparation at a high rate, before the personal one. However, other mechanisms of reparation for damage to the life project, such as rehabilitation and others, are also used, depending on the type of crime. In the present investigation, the AHP Neutral technique is applied to determine the importance of each of the evaluation criteria, in order to quantitatively evaluate a case of the affectation of persons by the commission of a crime. There will be a Case Base to compare the new case with other previous cases and the probability of improving it. Measurement scales in the form of linguistic terms will be used.
