Freedom of expression and the right to honor. Do these fundamental rights collide?

Abstract:

This research work allows identify the legal problems that have been generated with the collision of two fundamental rights such as freedom of expression and the right to honor, rights that, when consecrated in the maximum law of the State, have the same hierarchical level as the other fundamental rights; for this reason, there is a need to carry out an analysis of the solution mechanisms that have been used to resolve these conflicts. Therefore, an analysis of the doctrinal criteria on the ranking of fundamental rights in case of collision is presented, to compare the rights in conflict and to establish which of them deserves greater protection in the specific case.
