Glen and Michelle: Towards a non-structuralist phenomenology of femicide and gender violence
Abstract:
We warn the dangers of certain recent legislation on gender violence, including femicide’s, which has drawn from structuralist sources that are irrelevant in the redaction of the positive norm. The results tend to Manichaeism and to establish male guilt only because of the existence of a society with a patriarchal base. In this sense, the theoretical role of the structuralist source in politics and law is debated through the three-clocks model. The dangers of poorly conceived structuralism are indicated in the current norm and exegesis of several Latin American countries. Finally, the idea of gender violence is reconstructed from the category “situation”, based on the contribution of Geertz and Johnson, and the study of the case of Glen and Michelle, in British Social Work.
