Hacia una propuesta normativa en el derecho de migracion y extranjería
Abstract:
Immigration is an eminently sociological phenomenon that is regulated by the laws of countries all over the world. In the case of Ecuador, it may constitute a contribution to the development of society and an increase in cultural, social and economic development. At the same time, it can be seen as a deep social problem and a burden for the state, as Ecuador economic condition hardly allows it to provide for foreigners contributing little to the general welfare. This graduation project will focus on key legal elements relating to immigration. Currently, there are some immigration situations that lack clarity and do not have a defined legal framework under Ecuadorian law. The project formulates responses to a number of these existing immigration challenges. The sum of these responses could be considered a new legislative proposal that responds to current social realities. Additionally, the rights and obligations that arise under Ecuadorian law for those coming from overseas are analyzed within the project. These laws unquestionably ensure fundamental rights for any person defined as a foreigner. Uniform legal protection of foreigners results in a system where these rights and obligations apply to every person, regardless of their nationality or place of birth
