Herramientas e instrumentos legales que promueven la conservación de las áreas protegidas


Abstract:

The Environmental Law defines the set of legal rules of public and private that applied to the protection of all the elements that comprise the environment and that includes its own legal autonomy based on its principles and its own characteristics. Environmental legal history is relatively new because it originates itself in the sixties with the creation of American Law, "National Environmental Police," is considered new, more even when compared with other branches of law. Now concerning Protected Areas can be defined as certain wild areas which have laws or administrative employee to stay or protection. In Ecuador on Environmental juridical regulation establishing various international treaties (The Western Hemisphere Convention, the Ramsar Convention, the Biological Diversity Convention) and its regulation of internal nature (constitution of the Republic of Ecuador, Forestry Law and Conservation of Natural Areas and Wildlife, Law on National Parks and Reserves, Environmental Management Act, Unified Text of Legislation High Environmental) standards or environmental regulations are law and are constantly changing due to the nature of environmental issues. The main point to establish the protection of Protected Areas other than the coactivity of the law or legal regulation is one of the principles set out in Environmental Law, responsibility and accountability and environmental nature can be considered imputed an action that has environmental impact them and in Ecuador for the purpose of protection are established three types of environmental liabilities: Liability, Liability and Criminal Liability Management.
