Análisis comparativo de las políticas gubernamentales de Ecuador y Venezuela en el marco del derecho humano de la libertad de expresión


Abstract:

This research contains a comparative analysis to the most important in context of human right of freedom of speech government policies in Ecuador and Venezuela. This analysis begins in chapter one, with a philosophical approach to the origin of the terms: freedom, freedom in Greece and freedom speech, then the right is defined from the theory of fundamental rights of G. Peces Barba, finally several authors argue the reasons to defend freedom of speech in both countries. The second chapter describes both Ecuadorian and Venezuelan context that led to Rafael Correa and Hugo Chavez to power, the most important events that took place during the respective mandates, the relationship with the media that kept before being elected as presidents of executive power and the adoption of new media laws to regulate the media. The third chapter is composed of comparative tables showing the similarities and differences in government policies adopted by the Heads of State of Ecuador and Venezuela, those that are supported by an analysis based on reference authors mentioned in the first chapter to support the reasons to defend the freedom of expression. This chapter considered the most important of the analysis shows that the policies proposed violate freedom of speech. Finally, the last chapter contains the conclusions of the research conducted. Those conclusions lead to a necessary law to regulate freedom of speech because it is not an absolute right, however this should be subject to subsequent imposition of liability but not to censure that can attack against this law.
