INFLUENCE OF CANON LAW IN LATIN AMERICAN LEGAL SYSTEMS: ANALYSIS FROM THE PERSPECTIVE OF LEGAL PLURALISM


Abstract:

In the Middle Ages there was juridical pluralism, overcome with the Nation State that monopolizes the legislative power and regulates man in society, However, this fact, does not contradict that people are part of different institutions, such as the Catholic Church, which has its own norms or rules, which demand to be complied with by its members. With globalization, legal pluralism has re-emerged, which means that people find themselves under the regulation of a variety of legal systems. The objective of this research is to carry out a legal analysis of the influence of canon law in Latin American legal systems. The research follows a qualitative approach, with an explanatory scope, of documentary type, but at the same time projective since it intends to evidence the future of the interactions of the object of study. General research methods such as synthetic and systemic analytical methods are used. As for the study population, the Latin American legal system was taken as a case study. The result was that the human being is integral and is regulated by various legal systems, which provide values that are reflected in the construction and foundation and interaction between the various regulatory systems that make up the legal order.
