Abstract:

The economic benefits in the development of real estate projects through a Commercial Trust represent a profitable investment opportunity and an attractive figure for the development of construction projects, whether these are offices, commercial premises or housing; according to statistics in the city of Guayaquil, the demand for real estate projects has increased since the first decade of the second millennium, and since the Real Estate Trust is a strategic modality of safe business for the development of real estate projects, its analysis is proposed. Etymologically, the term "Trust" has its origin in Roman law, derived from the word "fiducia" which refers to trust and from the word "comittere" which means to entrust. In this sense, the Trust is an act of trust, in which the trustor entrusts (instructs) the Trustee to comply with the purposes or object mentioned in such constitutive contract. In order to carry out an appropriate research, information on opinions, criteria and experiences were collected from a set of significant persons for the research work, such as managers, accountants and administrators. The real estate trust is considered a legal figure, used by the companies dedicated to the construction with the purpose of assuring the financial operation and to have a better reception on the part of the purchasers at the moment of subscribing the promises and sales of real estate for the security that it grants, for this reason, it is indispensable the development of a methodology in procedures and with form, offering security to its clients and granting them economic yields to their investment.
