LA CANCELACIÓN DE MARCAS EN EL ECUADOR ¿UNA IMPERFECCIÓN DE EFECTIVIDAD?
Abstract:
The mark is a distinctive sign that differentiates from one good or service of any other, is a right of industrial property within Ecuador, which means that it is given to intangibles. Accompanied by this refers to a word, a logo, that is, something that calls and makes the mark as unique. The brand guarantees to the one who takes it an importance by reason of guaranteeing the origin, characteristics of the product or service bearing in mind that the information that the brand provides. It should be kept in mind that a condition without which the trademark can not have life in the legal world of Ecuador is that it must be used, since the non-use of this will affect the cancellation of the same, but: What right protects the cancellation of brands ?, What right does it affect? The main objective of the present investigation is to analyze the process of cancellation of trademarks and their effectiveness within the normative framework of CAN member countries and Ecuadorian legislation. For this purpose, the methodology of abstraction is used, that is to say, a quantitative and qualitative analysis will be carried out, in addition to the aforementioned, the exegetical method will be applied, in order to justify cases of cancellation of the mark.
