LEGAL ANALYSIS OF THE SPEED LIMIT OF PUBLIC TRANSPORTATION ON HIGHWAYS IN ECUADOR


Abstract:

When the right to life is violated, and the right of users of public service, there is a violation of articles 52 and 66 numerals 1, 2 and 3 literal a) of the Constitution of the Republic of Ecuador. A serious social problem has been detected that is affecting citizens who use interprovincial public transport, such as road traffic accidents. The objective of this work is to: Propose that new policies be established by the Ministry of Transport, where it requires interprovincial public transport companies to install a GPS device, to control speed, identify the transport and the driver, and that the information that generate the device is sent directly to the National Transit Agency. As one of the main methods, the Inductive method was used, which allowed a study to be carried out in a particular way and to guide general conclusions within the present investigation regarding traffic acci-dents. As a result, it is expressed that there is actually a high rate of traffic accidents in public transport, unlike cargo, where it is analyzed whether this is due to the speed limit established for this transport or because drivers are more careful when driving. respecting the speed limit.
