LEGAL IDENTIFICATION OF OCCUPATIONAL HAZARDS ASSOCIATED WITH THE GROUNDS FOR APPROVAL ACCORDING TO THE MINISTRY OF LABOR

Abstract:

The purpose of this research work is to identify factors associated with the affront that is set forth in the Labor Code as a cause for approval, both for the employer and the employee, and that established in Article 396 of the Organic Integral Penal Code, since in the latter regulation it is not typified as such, what it refers to is defamation without specifying serious or slight as a criminal contravention, leading to some doubts about its true scope and meaning. The methodology was based on a qualitative approach and the deductive method. The results provide a legal contribution to the scope of serious insult in the labor sphere. With this, it is concluded that the insult, as a cause of approval to terminate the labor relationship, violates the rights of the worker.
