La exigencia del pago previo como requisitos para ejercer medios de defensa frente a las actitudes de la administración pública

Abstract:

The work which has been presented will begin by giving a definition of “advance payment” before analyzing the characteristics which compose it by using existing research from various academics. The first chapter will revise the existence of the advance payment system according to Ecuadorian legislation and relevant comparative law. The second chapter will address the fundamentals of advance payments. This will include the reasons for the existence of such a system. On the other hand, the criticisms of advance payments will also be addressed. Issues will be exposed according to the opinions of renowned scholars. Additionally, it is considered suitable to refer to jurisprudence in order to contrast the advance payment method with already recognized constitutional rights. Finally, this thesis will conclude by summarizing the findings and will then offer recommendations, which contain clear guidelines in order to provide possible solutions for issues in the already existing advance payment system in Ecuador.
