La firma electrónica como medio para la incorporación del Ecuador a la dinámica del derecho de comercio internacional actual

Abstract:

The electronic signature authentication is the means by which to identify a holder, in relation to a data message information electronically recorded, which indicates its approval and fully recognizes. It has the same effect as the handwritten signature, and can be considered as evidence at trial. In Ecuador there is a certification entity which is the Central Bank, who is responsible for issuing digital certificates that guarantee the authenticity an integrity of documents. The electronic signature is internationally recognized by international conventions and treaties, which mainly embodies the principles of: non-discrimination, technological neutrality, functional equivalence and international support. The same who embody the importance of its application in international business transactions. In terms of international law provides the basis for most law issued by the UNCITRAL Model which contains articles that seek a harmonization between legal bodies to achieve the desire of the vast majority of international agencies, which is the elimination of trade barriers. At the present time has become an alternative to the need for agility and safety. It is recommended that for position in the market is allowed to open new certification bodies, which through competition achieve better services to users and achieve its benefits mainly advertising and thereby facilitate trade mainly through this channel. It is important to note that Ecuador through the insertion of electronic signatures has been showing signs of interest in being part of the dynamics of global trade.
