La incompatibilidad del régimen de citaciones que dispone el COGEP contra el procedimiento reglamentario para realizar citaciones, y la implementación del Código Postal como medio para determinar la residencia o el domicilio de la persona demandada.
Abstract:
The objective of this academic essay is to study a possible solution to the incompatibility resulting from the contrast of the requirements demanded by the plenary of the “Consejo de la Judicatura” for natural and legal persons who provide the service of citations at the national level: i) to have technology, logistics and national coverage that guarantee the provision of the service of citations at urban and rural level or capacity for expansion, and ii) to have the necessary training and enough trained personnel to provide the service; regulations for the citation process, whose content does not consider the implementation of the Postal Code as a tool that identifies citizens anywhere in the country, that is, it provides a geographical identity from which the Administration of Justice can be used. Once the citation done in due form constitutes a solemn element common to all the processes, whose omission can leave the defendant defenseless and consequently become one of the grounds for nullity of the process.
