Abstract:
The common-law union is not a practice of the current society, but it dates back to ancient epochs of the Roman Empire, where common-law marriage was acknowledged, at the beginning as an unmoral practice, that has not been abolished or terminated in the nowadays society, but on the contrary it has grown; currently, the amount of couples living in a common-law union arc more that marriage couples. In Ecuador such phenomenon has not started recently, aborigines in the pre-colonial age used to unite to each other through rituals celebrated in every community. Spaniards also used to unite with indigenous secretly, which give rise to fusion, since then, nobody, not even the church has succeeded to stop such a practice, in spite of risks and instability. The Constitution of the Republic protects the family living in common-law union as does with the family living in a marriage relation, but legislation is insufficient.
