La justicia indígena en el constitucionalismo ecuatoriano.


Abstract:

Indigenous justice, exists since the first indigenous people and native communities live not only in our country but in all our Andean Region. The origin, evolution, implementation, and characteristics of the indigenous justice raised with all the native communities that still live in Ecuador. Journalists and in general the media say that indigenous justice is primitive, savage and a kind of rudimentary system of justice. In spite of the constitucional recognition of indigenous justice, the last decade has been represented for some important cases about indigenous justice and human rights that were analized by the Constitutional Court and some legal authorities. Cases that introduced legal precedents in our system With those experiences, and because of the lack of coordination and coopertation of both legal systems in our country, the objective of this investigation is to evaluate from the perspective of human rights and our plurinational state, three relevant cases in which the conflict of coordination and cooperation of both juridical system is exposed.
