La manipulación en el mercado bursátil ecuatoriano
Abstract:
An efficient and effective functioning stock market is not only a fundamental piece in the development of the country, but also, the most efficacious financing source for companies, as well as, being a successful generator of capital for investors. Ecuador, in recent years, has seen a sustainable growth and development of the stock market. Unfortunately, along with this evolution; the self-benefiting illegal practices like insider trading have also surged. The rise of these practices bring along serious consequences. The public’s trust in the market could be deeply affected and thus skewed toward uncertainty; which can result in a weakened and even lack of interest of those who invest in the stock market. The biggest problem of this scenario would be that, the proper functioning of the stock market in the country, very quickly encounter serious hindrances. This is where judicial mandates come as an integral element in ensuring the safeguarding and further development of said stock market. It’s mission should be to establish clear and compelling regulations that aim at sustaining, protecting, monitoring and incentivising the market. Our country’s legal frame should, therefore, make progress subsequently and adapt to this emerging financial market, and thus be able to respond accordingly and in a satisfactory manner. To that end, this academic work addresses the fact that the national financial laws and stock market exchange legislations are not only insufficient and limited, and thereof lacking in Ecuador altogether. Especially, those laws concerning issues of market manipulation and insider trading in the stock market. Consequently, the scope of this research will scrutinize the performance of all players involved in the stock market environment and aim to define these illegal market manipulation practices, to expose exactly what they implicate. Furthermore, this research will delve into the concept of insider trading and its misuses; and hence, will examine Ecuador’s lack of regulations and compliance laws to prevent and punish these.
