La participación del Estado en el capital de una compañía de economía mixta a través de la concesión de la prestación de un servicio público: el caso del agua potable


Abstract:

From the beginning, water as a vital liquid, had always have a huge importance for all humanity, based on the reason that is indispensable for the development and satisfaction of all the basic necessities of the society, that would be in the future one of the causes of wars around the world. Each state has the obligation to guarantee their citizens the access to the public services of drinkable water, being able to provide it by the different models of interventions. Our Constitution establishes that Government can provide the public service directly by himself or otherwise indirectly, threw the delegation of the public service, considered as a strategic sector, to a mixed economy, in which the Public Administration must have the majority of the capital invested in the company. In this way, is based the reason of the following work, that tries to analyze how the contribution of the Government and those private entities, who prefer this mixed model works and how it gets regulated and administrated, its advantages and disadvantages and the results obtained in other countries of Latin American, such as Colombia.
