La participación del extraneus en los delitos de peculado.

Abstract:

This degree work analyzes the behavior and participation of the extraneus in the crimes of embezzlement. For this, the criminal type of embezzlement is analyzed, the history of this criminal type in successive criminal codes, the types of embezzlement, the legal analysis of the citizen who, not being a public official, concurs, together with the official, in the commission of this crime, which is known as extraneus. The degree of participation of the extraneus within the crime of embezzlement, the class of participation, the difference with the author and the assignment of the corresponding penalty has also been addressed. At the end, the conclusion is reached that it is necessary for the Comprehensive Organic Criminal Code to describe the precise role of the extraneus to avoid different pronouncements and opinions with reference to its participation in this crime.
