La violencia psicológica leve en violencia intrafamiliar y su contextualización como delito


Abstract:

This present research work with the theme theme "MILD PSYCHOLOGICAL VIOLENCE IN VIOLENCE INTRAFAMILIAR AND ITS CONTEXTUALIZATION AS A CRIME" proposes to apply this right as important as the right of protection and assistance to women and has a projection to ensure the welfare of the Family nucleus. This project is part of the analysis of mild psychological violence, because it is this form of interfamily violence, which has the highest incidence in Ecuadorian society, and also because the consequences or negative effects that it causes in the victim, can become much more serious than those caused by physical violence. In investigating the rules of the Integrated Criminal Code, it has been possible to determine that the coercive regime, in the penalties provided for punishing those responsible for this unlawful and inhuman conduct, are too weak and the procedural time is very long, and they do not keep Proportion to the seriousness of the conduct committed by the aggressor and to the negative consequences that this behavior causes on the victim, in addition in the Code indicated there are problems regarding the procedure applicable to adopt protective measures, aimed at helping the victim and The prevention of future aggressions, which entails a problematic in a legal framework that becomes the subject of study of this research, which according to the regulatory requirements have a broad theoretical basis, based on conceptual, doctrinal, legal and Legislation in general, and also has results obtained through the application of the survey, all of which supports the proposal of a proposal that is the main contribution that I make as a researcher, to provide effective protection to the right to physical integrity and Mental health of women and other members of the family.
