Las Nulidades Procesales en el nuevo ordenamiento Orgánico Integral de Procesos civiles en el Ecuador.


Abstract:

This paper seeks to ascertain whether the regulatory reform in the judicial system, improve the use of procedural nullity and compliance with due process, constitutional guarantee, which ensures that each process complies procedures previously designed, where the litigants and the authority have full ability to be vigilant compliance, avoiding omissions, defaults or negative actions that run counter to the nature of each process to the detriment of the parts; today allege a procedural nullity, it passes almost always presented as an exception to answer the complaint, and it no longer meets the legal technical role of appropriate procedural monitoring. The judicial system has been reformed, updating and standardizing the legal reality of the country; which maintained and outdated procedures in certain cases full of obstacles precluding the procedural agility, lengthening them unnecessarily, preventing allegations of procedural nullity be taken as an alleged dilatory incident.
