Legal analysis of the abandonment of cases typified in the general organic code of processes, based on sets of 2-tuple numbers


Abstract:

The main purpose of this article is the recognition of the constitutional rights and principles that are violated or not fully applied in the legal analysis of the abandonment of cases typified in the General Organic Code of Processes, in order to carry out an in-depth analysis regarding the administration of justice and thus establish a certain degree of equality in the consequences generated for the plaintiff by the failure to appear at the hearings. For this purpose, it was decided to use the 2-tuple sets of neutral numbers, which consists of an evaluation based on a linguistic scale as a form of Word Computation. This approach is more appropriate because it allows to evaluate and give results in the form of linguistic terms that are a natural and easy to understand by decision makers and users. The use of the neutral sets allows to include the indetermination caused by the lack of information or by contradictory and inconsistent information usually found in the problems of daily life.
