Lineamientos básicos para la implementación del control post- adopción dentro de la legislación ecuatoriana, en los procesos adoptivos internacionales tramitados en Quito desde los últimos seis meses del año 2009 hasta el año 2010

Abstract:

This thesis demonstrates the importance of new guidelines propose solution to the control post adoption within the Ecuadorian legislation. To establish itself as a reference, to improve the speed of the international adoption process in our society. The methodological foundation of the thesis is based mainly on the descriptiveexplanatory approach and different data collection techniques such as interview and survey. Because from them we determined the issue of research demonstrating the key shortcomings of our system of justice in matters of adoption. Therefore, when a legal decision is also a measure of social solution to the problem of abandoned infants, being a state obligation to provide stability. As the results of this research show that the adoptive parents are not in conformity with the pursuit of their legal proceedings, as well as one of the factors that affect this social problem is the bureaucracy and lack of real sanctions towards Judges who fail in the periods specified by law, disregarding the best interest of the child, which promulgates the Code of Children and Adolescents in our society
