Management of indetermination in the validation of legal investigation

Abstract:

Legal norms regulate the situation of migrants in any country. However, at the international level are primarily concerned to establish the fundamental human rights, but the legal development, both of the United Nations (UN) and the International Labour Organization (ILO) focuses primarily on the analysis of the situation of migrant workers in a regular situation, leaving aside the situation of workers and irregular migrants. In this research the documentary content analysis method was used to review and evaluate various sources, studies and legal documents. Likewise, the analytical-synthetic method is used, which allows us integrating the most important normative and jurisprudential sources. To support the validation, the use of neutrosophic logic and the neutrosophic Iadov technique is proposed for the satisfaction analysis of irregularities in the international legal field related to the human rights of migrant workers in Ecuador. In this study, a questionnaire was applied to 21 specialists in this subject. Neutrosophic logic generalizes fuzzy logic so that indeterminacy is explicitly taken into account as a component to measure. On the other hand, the Iadov technique allows evaluation by means of a logical table for decision-making.
