Análisis de las implicaciones jurídicas como efecto de la operación militar Fénix en el campo del derecho internacional humanitario


Abstract:

The “Phoenix” military operation was executed on March 1, 2008 by the Colombian military forces in the Angostura jungle region, located in Ecuadorian territory. As a result of this operation, several people were injured and 24 people died, including Raúl Reyes, the second commander in the Revolutionary Armed Forces of Colombia (FARC). The way in which this military operation was executed violates the International Humanitarian Right regulations which describe war crimes including murder, sentencing and enforcing without judicial rights, and not granting quarter. Nevertheless, these penal offenses cannot be sanctioned by the International Criminal Court because the Colombian Government, when ratifying the Rome Statute, took refuge in an exception established in this legal instrument. This fact does not mean that the acts performed in Angostura will be protected by impunity because they can be sued through other international legal subsystems.
