Necesidad de permitir la impugnación de la resolución en todos los juicios civiles.


Abstract:

The Code of Civil Procedure governing in our country, processes which by their nature are noticed appealed, but this has no relation to the constitutional provision which states that people have the right to appeal a judgment in any process or instance, so Therefore, there should be no resolution is not susceptible to challenge. There has always been the right to challenge decisions, since the source of the resource is just give a new course to trial, that one or more other people know of the decision or judgment for the purpose of confirmation or the decision is revoked, but always with the aim of guaranteeing the right to defend people, and obviously the right to due process. However in the Code of Civil Procedure there are some cases in the executive judgment as mandated by Art. 430 ibid run no appeal from the judgment against them, or in the case of despoiling in Art. 695 ibid, which its challenge is not allowed. For these reasons, in this thesis I show that it is necessary to allow the appeal to be limited in Art. 430 and 695 of the Code of Civil Procedure, to which must be reformed.
