PROCEDURE MANUAL FOR THE PROPER WEIGHING OF SUBSTANCES SUBJECT TO CONTROL IN LIQUID STATE: UPDATE


Abstract:

Organized crime has acquired an alarming social dimension, both because of its scale of connections and incidences, and because of the modus operandi with which drug traffickers act, which represents a threat to the stability of the international community, regardless of the criminal diversity that it emanates from it. Drug trafficking is one of the main sources of financing for its expansion. The social problem that organized crime represents requires the adoption of better investigation techniques to combat drugs; techniques that respond to the system of constitutional rights and guarantees. The problems are compounded when criminal groups become more capable of distracting the law. The objective of this study was to determine if the procedure to obtain the net weight of substances subject to control in liquid state (liquid cocaine) is adequate, guaranteeing due process. In addition, the methods used by organized crime to traffic drugs, especially liquid cocaine, were analyzed. Source analysis was used to analyze the exposed phenomenon. As a result, it was obtained that it is necessary for the procedure for weighing liquid cocaine to become more technical in such a way that the rights and constitutional guarantees of a citizen accused of committing this crime are not violated and correspond to the reality of the acts committed, as these are aggravated as the quantity seized increases.
