Periodismo sin garantismo ¿La reaparición de la picota pública?


Abstract:

This study inscribes within the debate between the constitutional principles of information and protection of honor. the purpose is to guide the reader through a critical description of this issue, referring on one hand, to the judicial situation of people who are apprehended in flagrant crimes, and on the other, to the social alarm caused by the media, when they include in their agendas the debate over public safety. the article deals with the crash between journalism and the guarantees of people under arrest, and demonstrates that they do not necessarily combine with the presumption of innocence. Finally, the study analyzes the social consequences of the criminal policy of imprisoned people.
