Positivización del derecho de los animales en Ecuador

Abstract:

This paper is about a proposal to pass a law for animal protection and wellbeing in the Ecuadorian Legal system. First, the paper discusses the findings of a research on the field of animal treatment through human history, for it is important to raise awareness of the relationship existing between both species. Second, on the basis of the universal declaration of animals the scope of the intended law is made. Having as referent the principles and activities of protection and animal wellbeing of international organizations, such as Royal Society for the prevention of cruelty to animals, the formation of an institution, which would directly be in charge of the matter as part of the Ministerio del Medio Ambiente, is presented. Then the laws on the field of countries such as Brazil, Bolivia and Peru, among others, are cited and commented. The next chapter discusses the laws and norms in animal treatment in Ecuador including international agreements and already existing institutions and initiatives. Chapter three displays Ecuadorian statistics of animal reality and biodiversity as the departing point to explain the reasons why a proposal like this is necessary. Finally, the rationale behind the law and the law itself are introduced.
