Pre-procedural mediation as a requirement in judicial actions regarding visiting regime
Abstract:
Mediation as part of the alternative means for conflict resolution has been implemented in various legal systems, consolidating itself as an effective way due to its various advantages, establishing itself as one of the most successful procedures for the resolution of family disputes. In this sense, the present work aimed to demonstrate the importance of pre-procedural mediation as a requirement in judicial actions of visitation. By virtue of which it was concluded that said requirement would contribute to solving problems such as limited advice from legal professionals, the high procedural burden in the corresponding Judicial Units, the worn-out interpersonal relationships between those involved and the lack of harmony in the society.
