Análisis del colapso del proceso oral en materia laboral según legislación ecuatoriana en la ciudad de Quito y mejoramiento del sistema

Abstract:

This work of thesis focus on making an analysis of the collapse of the oral process labor matter according to the Ecuadorian legislation in the city of Quito, whose main purpose is to find the causes of the collapse to make proposes to improve the system. The thesis begins with a detailed explanation of each component of the process according to the doctrine and positive laws. Later, starts the analysis of the causes of the collapse of the oral process, using: statistical facts of the Judiciary Council, a simple random sampling of sixty one cases that are processed in several courts of the city and the difficulties of the daily work, where you can get the mainly causes of the collapse in the oral process, which are: the limited number of courts, the physical and technological inability of the courts, lack of training of judged and judicial. Finally, after all the analysis, proposes are made to strengthen the operation of the labor oral process in the city of Quito, such as: increasing the number of courts, make permanents trainings to judged and judicial, implement new technological tools, among others.
