Propuesta de reforma a la ley notarial para viabilizar el empleo de medios telemáticos en la celebración de contratos de compra venta de bienes inmuebles

Abstract:

This essay proposes reforms to be carried out at the Notarial Law, in order to viable the conclusion of property contract by telematics means. For that purpose it has been analyzed telematic contratation and its components: electronic signature and data messages that provide legal security for use in the purchase of real estate, with the objective of establishing the notarys role in this kind of contract. In this investigation it has been used the deductive method as in the first chapter starts with the basics notions of the legal act, contract of sale of immovable property and contract telematic. Second chapter expresses the notarys role in analog contracts and telematic contracts, proposing some ideas about how to manage electronic public writing, how to replace the physical presence of contractors, the utilization of electronic signature by the notaries and the contractors, and request certified electronic copies of contracts and what interconnections would be relevant for the notaries, necessary to perfect the purchase of real estate contracts.
