Reflexión sobre la pena, un lugar legítimo para el perdón ante la reparación.

Abstract:

The present study makes a philosophical reflection on the Imprisonment, analyzing in depth its purpose and scope. It exposes it in a sense of infeasibility against the dignity of the human being and how it generates an evil, to the already existing evil. It criticizes the functionality of imprisonment and lands it in the Ecuadorian reality. Faced with this, it is proposed to give a place to the victim of the unjust criminal, where he can be compensated for the damage suffered. A reparation solution is proposed for those who have suffered the consequence of the crime. Thus, through forgiveness and reparation, we seek to give one more place legitimate and fair Criminal Law.
