Regulación laboral sobre el trabajo a bordo de Buques de pasaje.


Abstract:

The present essay has as main objective to make an analysis on the labor relations that are derivatives from a work contract signed between a cruise company and a worker, specifically it makes a study about the reality that affront the people that work on board on one of this boats. In the present job you would find a legal figure known as “Flags of convenience” which has been usedby most cruise companies in order to find a way of having less obligations and safe money in a legal way, by enrolling their ships in countries with convenient legislation that don’t implicate strict labor works and requirements, and also wherethey can find fiscal facilities, and that´s why this essay has the purpose to reveal thetruth that has been hidden about working on a cruise, by showing the problems and bad circumstances they have to affront every day because of the lack of regulationimparted to their employer, this people have lost their labor union rights, and are forced to work more hours than what is legally approved sometimes they have to work twelve hours without any break, and in most cases they don’t even take vacations, and that’s where I found the follow interrogation ¿ What actions does a worker on board of a cruise can have against their employer? This is a harsh reality that has not found yet any solution.
