SEXUAL SERVICES AS A FORM OF VIOLENCE AGAINST WOMENS


Abstract:

The provision of “sexual services” is a manifestation of violence, made invisible by traditional stereotypes. For this form of violence that harms fundamental and essentially gender rights, Ecuadorian legislation does not contemplate typicity or illegality. The legislative power has not been interested in indexing this problem, despite the moral and social reproach that this harmful activity receives. In the present investigative work, a legal analysis of the elements that make up this social problem was carried out. It was possible to show that the application of rights is lacking, there is no gender equality and people are objectified for a negligible value. Documentary information was collected on the regulations in force in other countries that sanction the use of sexual services. The convenience of applying it in our current legislation is analyzed. Surveys were conducted among experts in the law, in this case public defenders, criminal judges and sex workers. Whose results were important, it is concluded that sexual services do constitute a form of violence made invisible and practiced by our society against women.
