STUDY OF INFRACTIONAL REGULATIONS IN CRIMINAL CONTRAVENTIONS AGAINST PUBLIC ORDER CONTROL AGENTS IN ECUADOR


Abstract:

The objective of this research is to determine the lack of the principle of proportionality of the penalty in the criminal offenses against agents of public order control, contained in article 394 numeral 2, with respect to article 396. 1 and 4 of the Organic Integral Penal Code. The research modality was mixed, the techniques were interview and survey, concluding that the principle of proportionality and the dosage of the penalty are not efficiently applied, which constitutes a formal inequality, resulting in discrimination against public order control agents when sanctioning the same contraventional act in a different way from the sanctions established in the same code for private individuals.
