Análisis jurídico del delito de abuso de confianza en relación a la normativa establecida en el Código Orgánico Integral Penal 2014.

Abstract:

The Crime of trust Abuse, in which the victims of this type of fraud, unfortunately, have suffered in many cases emotional disorders; and, psychological, due to the injuries suffered in your patrimony produced by the fraud; being the basis to initiate a judicial process; and, in our country, this type of crime is maintained in the legal norms established in the Organic Comprehensive Criminal Code (COIP); and, other jurisprudence, for the reliability of the legal bases established in its legal norms; but the problem of this class of crime, is the one that is clearly observed, when there is abuse of a legal relationship between the author and his victim; in which the passive subject gives a position of the thing in a free and voluntary way to the active subject, the same that abuses the good faith of the passive subject, stripp ing it of its assets; The purpose of this investigative study is the importance of the application of legal norms in the judgments of the crime of abuse of trust, establishing policies and procedures in the operation, efficiency of each of the judicial pro cesses. This Project contains what is described below: Introduction, Theoretical Framework, analysis, problems, conclusions; and, bibliography.
