Abstract:

This thesis aims to subsistence coercive processes for debugging past due loans in the Drinking Water Municipal Public Company, Sewerage System and Integrated Services of solid waste management, urban and rural cantons: Bolívar, Junín, San Vicente, Sucre and Tosagua - EMAARS-EP; according to the correct application of the basic guarantees of due process enshrined in our current Constitution that all citizens have to resolve legal disputes that are known to the judges. The existence of a high-performing loans dating back more than five years, prevents proper system sustainability and improve services. It is desirable to establish procedures for timely collection and economic management to ensure the effective collection. This means management must specify the development of activities that must be met in the efficiency of processes; the same will be achieved through the coercive jurisdiction, for being an authority granted by the exercise of self-governance Public Administration to proceed with the recovery of the values due without resorting to the courts, the procedure is established in the Code of Civil Procedure; the interest of the problematic is that the current Code of General Process, becomes the lack of coercive jurisdiction application, the same that is executed by any Public Administration that have been delegated the authority to exercise charging through legal means all that is due to the State.
