THE ADMINISTRATION OF JUSTICE IN THE INDIGENOUS POPULATION, CULTURAL DISCRIMINATION


Abstract:

The relevance of this work emerges from the voice of the oppressed people who have had to change customs, habits and language to be accepted and not discriminated by a hegemonic culture, although we believe that these unjustified diffe-rentiated treatments towards indigenous people have diminished, we must return our gaze to the streets and see how the constitutional mandate of equality is far from reality. The research addresses cultural discrimination, prejudices and discrimi-natory behaviors present in the administration of justice against the indigenous population; interculturality and plurinationality are analyzed from a constitutional and doctrinal approach. The methods applied were qualitative-quantitative; it focuses on the total study, disaggregating by parts to establish the causes, nature and effects of the research. The techniques and ins-truments were bibliographic, documentary and interview; it was possible to determine that those who define themselves as indigenous are treated differently by public servants of the judicial body.
