THE ENJOYMENT OF THE MATERNITY LICENSE IN ECUADOR


Abstract:

Although maternity leave in Ecuador constitutes an important form of protection for the worker and especially for her son or daughter, the following problem can be identified: Does the lack of greater flexibility in maternity leave, which allows the worker to take the last 8 days of maternity leave at any time within the first year after the birth of her son or daughter, violate the right to health and labor stability? In fact, it is necessary to take into consideration that once the worker returns to work - after the 12 weeks of paid leave - circumstances may arise that force the worker to miss work; therefore, the objective of this research was: To establish the need to make maternity leave more flexible, establishing that the last 8 days of maternity leave can be taken at any time within the first year after the birth of her son or daughter, in order to guarantee the right to health and labor stability. This research was descriptive and explanatory; the technique used was the survey, and the instrument used was the questionnaire, which resulted in the need to make the last 8 days of maternity leave more flexible.
