THE PRISONS OF EXCLUSION. THE FAILURE OF THE RESOCIALIZING DISCOURSE AND THE EMERGING CRIMINOLOGICAL ACT


Abstract:

The present investigative work had as its mainstay the prison massacre produced in Ecuador in the month of September 2021, where different criminogenic factors were found that are of interest to Critical Criminology. From this perspective, the objectives were established to study the current situation of prisons in Ecuador through a critical criminological approach and to reveal their current state and its implications in the criminal question, to propose points of support for a renewed critical criminological theory. In the methodological part, the qualitative approach was established, whose technique was the case study, to approach the empirical from criminological criticism and its multifaceted approach and the Pestel method. The result and conclusions of this work revolved around the effects of punitive power and the emerging actuarial Criminology, which affect people who experience pain and exclusion and propose alternatives that help contain these effects and safeguard the democratic State.
