THE SUBSTANTIATION OF ADMINISTRATIVE PROCEEDINGS AGAINST TEA-CHERS IN THE PUBLIC EDUCATION SYSTEM AND THEIR CONSEQUENCES ON THE DECISIONS ISSUED


Abstract:

The Organic Law of Intercultural Education and its General Regulations, has determined that the substantiation of the Administrative Summaries established against the teachers of the fiscal education system, would be in charge of the Instructor Summary, who sends the final report to the District Resolution Board of conflicts. Said Board is made up of the District Director, the Head of Human Talent and the Head of Legal Counsel, with which it is evident that only one of its members meets the profile to be able to analyze a resolution under the legal parameters guaranteeing due process in the Resolutions of Administrative Summaries. The objective of this research is to design a draft reform to the Organic Law of Intercultural Education, establishing an article that determines the profiles of the members of the District Conflict Resolution Boards, so that the members of this collegiate body, guarantee the due process in the Administrative Summaries initiated to the teachers of the public schools and colleges. The Historical-Logical, Inductive-Deductive, Analytical-Synthetic and Documentary methods were used. The results obtained through the application of a survey aimed at legal professionals determined the importance of the application of this research.
