Teaching in the Legal Sciences: Case of inexcusable error of the judge and interference in the administration of justice of Ecuador


Abstract:

The present study has as scenario the administrative files promoted by the Disciplinary Control Unit of the Judiciary Council, through which a sanctioning procedure has been implemented that has ended with the imposition of dismissal on several judges of the Republic of Ecuador. The arguments that lead to analyze this administrative action, will be the answers to the concern of jurists and researchers who manage to unravel a questioned administrative sanction and an exercise of excessive administrative power and its limits. The exercise of the sanctioning power of the Council of the Judiciary as a tool for intervention in the decision of the judges is the sample of the interference of the administrative function in the judicial and indigenous justice function, breaking the independence of powers that characterizes the Republic.
