The institutional function of the ecuadorian state to prevent child and adolescent abuse
Abstract:
The violence suffered by children and adolescents is caused in two very specific spheres, that is, parents, people who have been entrusted with their care; and teachers, who assume a form of discipline. The purpose of the research was to analyze the current legal order related to children and adolescents; and the role of the State institutions in whose responsibility lies the prevention of the indexes of violence and mistreatment that children suffer. A type of descriptive research was used, with a documentary design. The results show that the high indexes of physical and psychological violence suffered by children still continue, including inhuman or degrading treatment or punishment, physical punishment in the family, sexual abuse, sexual exploitation, trafficking and smuggling. In conclusion, the constitutional obligation by not proposing a law or legal body that grants the instruments to the judges or administrative authorities, such as the Cantonal Board for the Protection of the Rights of Children and Adolescents, then urges an institutional restructuring that addresses the situation with procedures that reach a happy ending and reduce violence.
